Bidding after an open day at rental property

We are currently having to move to a wheelchair friendly property as my fiance was diagnosed with cancer. So that only leaves us with new builds or ground floor.

Curran and Pinner in Beckenham, Kent hosted an open day for a property with lifts and good access for us. What we didn’t know was that there would be an endless stream of people within 5 mins of each other and more than one agent showing people around. Knowing what the market is like here and experience, we saw it and stated there and then that we wanted to take it. Told the agent before we left and she explained the process for taking it ‘off the market’. She called 2 hours later in the afternoon to ask advise us that in order to strengthen our position that we raise our rent ‘bid’. We explained the reasons we needed a property like this,  perhaps more than say others would, and that that was our max budget. She said she would be in touch to let us know. Frankly she asked us nothing about ourselves to determine if we would be good tenants other than the generic registration form.

How are they able to do this legally and is there anything we can do about it?

As frustrating as it is, I believe it is the landlord’s choice if this is a private rented property. They will most likely simply go with whoever makes the highest bid if they are renting on advice from the agent. If they had agreed in writing to accept your bid and take the property off the market, and then didn’t, then you may have a cause for complaint but otherwise, as far as I know, landlords can choose whatever tenants they want.

It might be worth trying to get in touch with the landlord directly. You can do a search at the Land Registry (£3) and that will tell you who owns the property. Obviously the agents will probably be annoyed if you go direct to the landlord but there’s nothing to say that you can’t do that. If it’s a person (rather than a landlord company) then tell them the reasons why you need the property and what great tenants you’d be. If the agent says anything then you can simply point out that you wanted to make sure the landlord knew everything about you and the agents didn’t give you the opportunity to do that because of the generic form. It might be worth a try.
