Burglary Damage - Who Pays?

Our rented flat was broken into, in the process the Yale lock was broken and cost £100 to repair. The landlord is refusing to pay this on the basis we didn’t also lock the door with the mortice lock. We didn’t use the mortice lock as it wasn’t working although the landlord did not know this.

Does the fact that we didn’t use the mortice lock mean that the landlord isn’t liable for the repair cost?

Possibly relevant is that the burglar wouldn’t have known that the mortice lock wasn’t working prior to attempting to break in?

This becomes a complicated issue. 

The burglar wouldn’t have known about the mortice lock, but they couldn’t have been deterred if this lock was put in place. 

As for the mortice itself, the problem is that you haven’t reported the malfunctioning lock itself. If you did, you would have waived all responsibility from yourself and the landlord will be required to repair both locks. 

However, having not reported the problem, you took the landlord’s  opportunity to do repairs and prevent the breaking in, thus the second lock being destroyed. As it currently stands, the landlord’s refusal may be legitimate and you may be liable to repair the lock yourself. 

Sorry, but this is why it’s extremely important to report any issue as it is discovered / created.
