Discrepancy in rent increase between tenants

I have been a tenant in an hmo for two years sharing with 5 others.

Only myself and two others are the original tenants and our monthly rent is the same.

Their rooms are smaller than mine, but mine is rented unfurnished and theirs furnished.

My landlord has recently written to all three of us stating they are putting the rent, which is fine in principle however they are proposing that mine increase by 5% a month whilst the other two tenants is only proposed to increase by 3%

I have asked them why this is the case and they have said it’s to bring the rent in line with the larger rooms. I asked them why they feel an unfurnished room is comparable to a furnished one but not had a response.

Can they do this if the increase is not the same for all tenants?

Unfortunately for you, your landlord can do this. Each tenant has their own Assured Shorthold tenancy agreement with the landlord. Increasing the rent means that a new agreement would be signed, where the landlord and tenant both agree to the new rent. 

As long as both actually agree on the rent, everything is fine. Your roommate will probably agree. Or, you can form a micro-syndicate and force the landlord to go down. 

Anyway, what the rent price IS for each room is entirely the decision of your landlord. The Office of Fair Trading offers a complaint route to dispute unfair rent prices. However, it usually deals with rentals that are too exorbitantly priced compared to other local properties.

Your landlord is increasing your rent by only 5%, and you seem to agree that it is a fair price, so it’s very unlikely the OFT will do anything here. 

Your options are to either accept this rent and take the hit, or leave the property. 

It’s not always fair.
