Hi! My tenancy agreement ended middle of January. The agent came and checked the flat end of October. He said the flat looks lovely and I can stay as long as I want. He also told me to send an email to inform him how long my new contract I would like to be. I’ve sent him the email. That was november. He didn’t answer. I called him one week before my contract came to an end. He tried to look surprised and he said he’s going to send me by post a new contract to be signed off that day. That was almost one month ago. Still didn’t get any new contract. I’ve sent him another email. He doesn’t answer. I live in this flat without a contract right now. How bad is this? And what issues can arise? Is it something I should worry about? In this situation I think he can give me any time 2 months notice to move out. Should I chase him? Is it legal to be a tenant without a contract? I would appreciate any advice. Thank you very much.

Hi Alice

When your written tenancy comes to an end, as long as neither you not the landlord give notice then your tenancy becomes a statutory periodic tenancy. Your contract is with the landlord, the agent works for the landlord, acting on his behalf.

Your rent and conditions remain the same as with the previous contract and the landlord will need to give you two months notice. If you want to leave you need to give an entire rental period’s worth of notice (usually a month).

Periodic tenancies are not ‘bad’ it just means that the landlord can give you two months notice at any time. There’s some more information on periodic tenancies here.
