lanlord wants to visit and I wont be home

Landlord has text stating they want to visit propert, given 4 days notice,which is fine. However I have said we wont be in and asked for another day,They have come back stating they have the right to enter on day they stated. Also I know they are only doing this as our rent is late due to bank error. They have also failed to repair broken window cills. They only ever contact us on rent days. I used to pay my rent in advance as always get paid 27th so payed it then as rent due 1st. When they didnt get it on 27th constantlt text asking for it,I always replied rent not due till 1st…can anyone help answer if i can refuse entry on that day ? thanks

There’s some info here on the landlord’s right of entry and what to do if you feel that your rights are not being respected.

As you say the notice they have given is fine but if it’s not convenient for you on that day then you should be able to suggest an alternative.

Although you could need to get legal advice from an organisation like Shelter to confirm this, normally the landlord needs your permission to enter the property to avoid a claim of trespass or harassment, even if they have given you notice. You have a legal right to quiet enjoyment which some landlords conveniently forget because they consider the property to be ‘theirs’ – even though, with your rent, you’re paying to occupy it undisturbed. That right of quiet enjoyment means you get to have a say in when landlord visits take place (unless it’s an emergency like a burst pipe). Anyone who enters a property that someone else has a legal right to occupy without their permission is normally on shaky ground.

Just remember that if you want to stay in the property it’s a good idea to try and come to a mutually beneficial solution (although admittedly this can be difficult with a landlord who doesn’t understand their legal obligations).
