Prescribed Information- Deposit Certificate Not Received

Hi, we’ve been served a Section 21 but did not receive the Deposit Certifcate (proof that it had been deposited) within 30 days. Is this part of the Prescribed Information?

Hi Scott 

Yes absolutely, you should have received this prescribed information – confirmation of your deposit being protected. If you haven’t, the Section 21 is invalid. Your LL will need to return your deposit or protect it now. then the LL can re serve the Section 21. 

If your tenancy began after April 2007, your LL could be liable for a fine of up to 3 times of what you paid. Therefore if they fail to follow the rules, you can make a claim to the court by completing a form n208. There is more information on the Shelter website.
