Removing A Sofa

Hi, we moved into a part furnished 2 bed flat in september, the living rooms converted to a bedroom, (london living). To cut a long story short, In my bedroom/living room is a large stained sofa, i asked the landlord if he could remove this when we moved in. Assuming he would just agree because of the state its in i moved the sofa to the hallway and bought a desk for my room. he denied this request and said if we dont want it in the flat we have to pay for storage for the year. Which obviously we wont do.  The sofa is on the inventory that we signed so is there anything we can do??

If we get rid of it the landlord could charge us what ever he wants for a new sofa?

At the moment the sofas been in the hallway for months and we simply cant live with it anymore.

Unfortunately if the sofa is on the inventory at the check in then it needs to be on the inventory at the check out. However, usually, the landlord can’t charge you for a brand new one if you decide to get rid of it. There is a concept called ‘betterment’ which means that the landlord can’t try to put themselves in a better position when you move out than they were when you moved in – charging you for a brand new sofa to replace an old, stained one would go against that.

The landlord would probably argue against that, as most landlords do. However, if they were to try and hold on to some of your deposit to pay for a brand new one then you could dispute this with the deposit protection scheme holding your deposit and they should (although I’m not a lawyer) tell the landlord he can only claim the value of a similar sofa. So, if you were going to risk this the first step would be to find out which scheme your deposit is protected by and familiarise yourself with their dispute procedure and the kind of ‘evidence’ you’d need. Then take lots of photos of the sofa. Hopefully it says on the inventory that it’s in bad condition (if it doesn’t then you may have a problem). Maybe research the cost of a second hand sofa (with or without stains!) to get an idea of how much you might be liable for.  

When it comes to check out you can either offer to replace the sofa with something similar or make a financial offer. If neither is accepted then take it to the tenancy disputes service.
