I have been living with my girlfriend for the last year and she is on the tenancy agreement. I moved in years later and now she wants to get another place. She has a child that is 7 years old. She know wants to move out but I have messed up in the past and got 2 CCJ’S  one of them I didn’t even know about and the other I only found out about 2 months ago. How can we rent a place with my credit record so rubbish. We have looked at private renting but there is nothing going in the area where we live. If you could give some advice on how we/I can move. I am so stuck and scared. I have been trying to fix my credit record for ages and it feels like I get no where. I feel like she will leave me if we can’t get another place. Hi Kyle.

 

Sorry to hear you are feeling so uncertain about things. But try not to let your fears get the better of you. Whatever you are worried about, you will be much more able to sort things out if you can keep calm and rational.

 

It sounds as though you may be anticipating the problems you might have, rather than confronting a problem you definitely do have.

 

In fact, it may well be the case that the two CCJ’s on your Credit History won’t actually prevent you and your partner from moving to a new place.

 

If I were you, I would just go ahead and start looking for places, and when you and your partner and her child find somewhere you like the look of, just start the application process.

 

Just having a CCJ or two on your Credit Record is not going to be an automatic block for every prospective landlord. It may be for some, but not all.

 

A lot will depend on the nature of the CCJs – how much, how recent, are they now discharged etc. – and a lot will also depend on how keen a prospective landlord is to rent his or her property to you.

 

Whenever a landlord rents a property, they always have to take something of a risk. They want to know that there are unlikely to be any problems paying the rent, of course; but they also want to feel reassured that their property is going to be well looked after, and the new tenants aren’t going to cause any problems with the neighbours.

 

So it isn’t just about whether or not a prospective tenant has a sparkling clean Credit History.

 

The thing is, you won’t know until you try.

 

If you go through a Letting Agency to find a new place to rent, the Agent will be keen to earn their commission, which they will only get if they secure you a tenancy. And this can actually help you, as your Agent will have an incentive to convince a new landlord to accept the fact that you have two CCJ’s.

 

I wouldn’t mention your CCJ’s to any agent, until/unless you see a property that you and your partner really want to go for. When you do find a place you want to apply for, you can then mention your CCJ’s *BEFORE* you agree to pay any referencing fees or holding deposits.

 

If when you mention your CCJ’s to the agent, they immediately tell you that there is no possibility of your getting the tenancy, then you will have lost nothing and be no worse off than you were before.

 

If your agent tells you that your CCJ’s should not or may not be a problem, you should then ask them to let the prospective landlord know the details of your CCJs (the details that would be revealed in a Reference Search), again *BEFORE* you commit to spending any money on Reference fees.

 

If the prospective landlord indicates that they have no problem with your CCJ – perhaps they may suggest that the new tenancy be done in your partner’s name only – then you can proceed with the application and referencing, knowing that the worst information has already been revealed.

 

Point being that you will not know until you try.

 

And I really think that when you do try, you may be surprised to discover that your CCJ’s are not quite as big an obstacle as you are fearing they are.
