Hi all,  my AST tenacy contract expired last November which I totally forgot.  No  renewal was entered.  I want to move per November 1st and sent a notice on  30 September as I had a 1 month notice period under my previous contract which expired last year.  My landlord is telling that i have automatically entered into a revolving contract post last years expiry where it’s common to have a two months notice period.  I am quite astonished that I have apparently agreed to some roll over contract without my consent.  Are two months valid in this case?

Your landlord is both right and wrong: 

When the tenancy agreement expires, it rolls into a periodic tenancy, where the conditions remain the same as the signed agreement with an exception that both parties can end the tenancy by providing notice. 

For tenants, it’s usually one month, unless the tenancy agreement you signed says differently. It doesn’t.

For landlords, the notice period is two months, also know as Section 21 Eviction notice.

Your landlord is likely trying to get another month out of you as they find another tenant.
