Signing Special Conditions to House Sale Contract?

Does anyone have any experience of being asked to sign a Special Conditions clause to the sale contract by the landlord’s solicitor? The conditions only refer to vacating the property on an unspecified completion date and releasing the property from any rights that we have.



Hi there, thanks for your post. We haven’t come across this in our forums, but it sounds as though your landlord may be considering selling the property, or re-mortgaging.

“Occupier’s consent: Special Condition 7 provides for named occupiers of the property (that is, any adults in occupation of the property other than the seller) to sign the contract to confirm their agreement to the sale and to release any rights they might have in the property and any fixtures and contents included in the sale.”

Are you signing an initial Assured Shorthold Tenancy agreement with a fixed term, or renewing a tenancy agreement for another fixed term? If the landlord does sell, the new owner would not be able to evict you until the end of your fixed term, in which case you would be given two months’ notice to move out.
