When i moved into my property the landlord did not freshly paint. He did fill holes but painted over the filler with completly the wrong shade/colour. Since living there (5 years) i have decorated all rooms apart from the hall stairs, landing and kitchen. They are looking tired and marked! Am i liable to repaint these as they were not freshly painted when i moved in?

Also, the washing machine had a number of slow leaks in the utility room and as a resuly the skirting has rotted away. I advised the landlords agents but nothing has been done. I am assuming it is his responsibilty to repair.

One last point, I am moving out February 22nd. The agent is calculating my rent as 22 days out of 28, which leaves me £157 out of pocket compared to calculting an average daily rate based on this formula: monthly rent x 12 / 365 x 22 days. Who is right?

Your formula calculates rent per day, as if all months in the year had the same amount of days – 30.41.

Your agent calculates rent by dividing your total monthly rent by the number of days in February. 

I will be inclined to side with the agent, because your total due rent for February is the same as for January, but the number of days in each month are different.  

To insist on using your formula, would be the same as to insist on paying less for February than January, because of the difference in days. Also, your rent is calculated per month, not per day.  

As for wear and tear, 5 years is a long time and the landlord cannot except to receive the property as if brand new. I’m sure you’ve cared and maintained the property as best you could, but every house needs a lick of paint every five years or so. 

If there is nothing extraordinarily damaged, you should be looking to receive your full deposit.
